Panel #1: Litigation Funding
While big business in the UK and elsewhere for a while, commercial litigation funding, whereby a plaintiff in a lawsuit can hedge or transfer the cost of litigation by essentially “selling” the right to part of its recovery (if any) to a third party was virtually unknown in the United States as recently as 15 years ago (that is, if you leave aside the fact that any contingency fee arrangement is arguably no different). Today, however, having crossed the pond, commercial litigation funding is “hot.” And it is particularly relevant to lenders and distressed companies. This panel will discuss the basics of commercial litigation funding and, in particular, its applicability to members of AIRA and NYIC.
