14th Annual NYIC/AIRA Joint Bankruptcy and Restructuring Event

Tuesday, January 22, 2019 (11:00 AM - 2:30 PM) (EST)

Join NYIC and AIRA for a Cutting Edge Finance & Restructuring Event

“Evolve or die.” This is an essential takeaway for anyone who has studied Schumpeter’s writings on creative destruction. In its continuing mission to help their respective members stay up to speed on the latest innovations in lending, NYIC and AIRA are pleased to present panels on two of the hottest topics in lending today: financing of litigation and financing of the cannabis industry.

Panel #1: Litigation Funding
While big business in the UK and elsewhere for a while, commercial litigation funding, whereby a plaintiff in a lawsuit can hedge or transfer the cost of litigation by essentially “selling” the right to part of its recovery (if any) to a third party was virtually unknown in the United States as recently as 15 years ago (that is, if you leave aside the fact that any contingency fee arrangement is arguably no different). Today, however, having crossed the pond, commercial litigation funding is “hot.” And it is particularly relevant to lenders and distressed companies. This panel will discuss the basics of commercial litigation funding and, in particular, its applicability to members of AIRA and NYIC.

Moderator, Jonathan Friedland, Partner, Sugar Felsenthal Grais & Helsinger LLP
Ken Epstein, Investment Manager, Legal Counsel, Bentham IMF
Martin Flics, Senior Bankruptcy Advisor, Parabellum Capital LLC
Michael Kelley, Partner, Arent Fox

Panel #2: Cannabis Program
The issues today and the ones to follow. The legal issues and financing needs that could make this industry one of the biggest in the US.
