LUNCH KEYNOTE: When Worlds Collide; Legal Issues Creating Conflict Between Fintech Lenders and Traditional ABL and Factors

As Fintech lenders offer  increasing amounts of  (secured?) credit to the client base of asset based  lenders and recourse factors, heretofore dormant legal issues come into  play.  Bob  will explore issues such as (i) use of confessions of judgment,  (ii)  the value of negative pledge clauses, (iii) the viability of tortious   interference claims, (iv) the exploitation of Fintech lenders of a  factor  becoming an account debtor by the use of notices of assignment.   Bob will  also explore the impact of existing and possible future  regulation on Fintech  and traditional lending.  So much to cover; so  little time.
